The following Terms & Conditions govern the rights and obligations of OPTIMUS GOLF LIMITED (Business Name: OPTIMUS GOLF PERFORMANCE “OGP” or the “Company” or “We” or “Us”) and you. By using our facilities and services, you agree to the following:
Safety
- Maintain awareness: There is always a risk of ricochets and golf balls traveling toward you. It is your responsibility to stay vigilant and aware of your surroundings.
- Swing only in designated Areas: Only take golf swings in the designated areas.
- Pay attention during swings: Do not walk around or approach a golfer who is in the process of swinging.
Liability Disclaimer: To the fullest extent permitted by Hong Kong law,Optimus Golf Limited excludes liability for negligance.
Cleanliness
- Leave it clean: Tidy up after your session in any area you use.
- Dispose of trash: Dispose of all outside trash in the designated bins.
- Non-compliance: Clients who consistently leave the facility in poor condition and ignore warnings may have their packages revoked – any remaining Credits will be forfeited.
Visitor Bookings
- Advance Booking: Visitors may book up to 1 week in advance, subject to availability.
- Payment Confirmation: Full payment must be made in advance to confirm your booking.
- Late Cancellations and No-Shows: Late cancellations (within 24 hours) or no-shows will result in the forfeiture of the entire booking, and no refunds will be issued.
- Amendment Limit: Only one amendment is allowed per confirmed booking, and the amendment booking must be within 2 weeks of the original date booking.
Credits & Tokens
- Spending Credits: Spending Credits are earned through the purchase of Credit Packages (including sign-ups and renewals) or via our referral schemes. Spending Credits are not a circulation currency – They are only valid for exchanging our services and products, together our “Service Offerings”.
- Session Tokens: Session Tokens are earned through the purchase of Passes and Packs. They are only valid for exchanging our services and products, together our “Service Offerings”.
Expiry Dates: Both Spending Credits and Session Tokens have expiration dates, as defined in the Credit Package, Passes, Packs and Enrollment Form, which are strictly enforced unless a
legitimate medical or compassionate reason is provided with proof. - Account Benefits Validity: So long as your Credit Package isValid, you may enjoy discounts and/or other benefits (“Account Benefits”) for our Service Offerings. You may opt to pay for
Service Offerings separately (without deducting Spending Credit balance), knowing this may result in unused Spending Credit expiring at the expiry date. A Credit Package is Valid when: 1) There is a positive Spending Credit balance; or 2) Spending Credits earned at sign-up and renewals have not expired. - Non-Transferable: Spending Credits and Tokens cannot be converted into cash, resold, or transferred.
Credit Package Extensions
- Extensions: We offer extensions for Credit Packages for up to a maximum of 6 months from the original expiration date. Administrative Fees apply.
Rollover Credits of Tokens
- Rollover of Spending Credits: Unused Spending Credits may rollover upon renewal. Rollover policy only applies when the renewal date is before the expiry of the current Credit Package.
Rollover of Session Tokens: Unused Session Tokens may be partially rolled over, subject to individual T&Cs of Passes and Packages.
Sharing – Linked Accounts
- Primary Account Holder: Credits and tokens are held by the Primary Account Holder.
- Linked Accounts: Linked Accounts are individuals including spouses, children, parents, or other individuals (applicable only to buddy account) authorized by the Primary Account Holder to use Credits tokens and enjoy Account Benefits.
- Responsibility: Primary Account Holder assumes full responsibility for Linked Accounts in ensuring they comply withthese terms.
- Disputes: OGP is not liable for disagreements between Primary and Linked Accounts.
Record Updates: Primary Account Holder must notify OGP of changes in Linked Accounts. Each removal and addition will be subject to a $250 administrative charge. - Minors: For Linked Accounts under the Age of 18, the Primary Account Holder warrants they are the parent/legal guardian and accepts liability on their behalf.
- One account: Primary Account Holder and Linked Accounts are considered one Client Account.
No Refund Policy
- Non-refundable: Credit Packages, Passes and Packs are each individually offered as a complete product to access additional Account Benefits. Any unused Credits and Tokens are non
refundable. - Special Circumstances: In certain situations, such as a medical condition, serious injury, pregnancy, or relocation outside of Hong Kong, we may consider allowing a partial refund or the
transfer of credits to another individual on a case-by-case basis.
Administrative Fees may apply.
Bookings
- Advance Reservations: Clients with Valid Credit Packages, or active Passes/Packs may make bookings up to 2 weeks in advance.
- Recurring Bookings: Recurring bookings beyond the 2-week advance reservation period are available only to clients with valid Credit Packages or active Passes/Packs. To arrange recurring bookings, please inform your coach or the Front Desk.
- Reservation Policy: Reservations for all services are non transferable and made on a first-come, first-served basis. Bookings cannot be made for someone else. Primary Account Holders and/or Linked Accounts must be present for their bookings. OGP reserves the right to request valid identification
at the time of use of services. - Minimum Reservation: The minimum reservation time for Facility Rental is 30 minutes. For other services, the minimum reservation time is 60 minutes.
- Fair Usage Policy: If you arrive early and use an available facility, you will be charged for the additional time in 30-minute blocks. Similarly, if you exceed your booked time, you will be charged accordingly. Each Client Account may make up to 2 concurrent Facility Rental bookings on any given day and time.
Responsibility for Bookings: It is the client’s responsibility to make bookings. OGP is not liable for a client’s failure to make bookings due to personal scheduling conflicts or ad-hoc arrangements.
Claiming / Returning Facilities
- Punctuality: Please arrive on time for your bookings. Late arrivals will not be compensated.
- Grace Period: Each booking will have a 15-minute grace period after the stated booking start time. After that, the booking is considered a late cancellation and may be released to others.
Cancellation and Amendments Policy
- Requests: For any amendments or cancellations, please submit your request at least 24 hours prior to the booking time through the customer service hotline or your coach. For calls to the customer service hotline, is available only during our operating hours.
- 24-Hour Policy: Cancellations or amendments made within 24 hours of the scheduled booking will be considered a late cancellation, and the fees will not be refunded.
- Three-Strike Policy: Your booking rights may be suspended for 14 days if you accumulate three late cancellations. Please note that the expiry date of your Credit Packages, Passes and Packs
will not be extended as a result.
Bad Weather Policies
- Red or Amber Rainstorm/Typhoon Signal No. 3 or Below:The Facility will operate as usual, late cancellation charges will apply.
- Black Rainstorm/Typhoon Signal No. 8 or Above: Late cancellation charges will be waived for sessions on a day when a Black Rainstorm or Typhoon Signal No. 8 is in effect.
Food and Drinks
- Strictly No Alcohol: The consumption of alcohol is prohibited on the premises.
Damages
- Damages: You are responsible for any damage caused by fault or negligence, outside of normal use of the Facility.
- Replacement Costs: You will be required to pay reasonable replacement costs for all damages incurred.
Bag Storage and Locker Service
- Responsibility: You are responsible for your golf clubs and possession stored at the Facility. Please count all items and ensure they are properly protected and stored in your bag before returning it to your locker.
- Condition: We reserve the right to refuse bag storage requests if your golf clubs and equipment are in such condition that may cause hygiene or safety issues at our premises.
Liability Disclaimer: We are not responsible for any loss or damage to golf bags, clubs, or equipment stored in your locker. - Inspection Rights: We reserve the right to inspect all stored items without prior notification. Any illegal substances found in violation of HKSAR law will be reported to the Hong Kong Police.
Storage Duration and Fees: Stored items will be kept at the Facility for a maximum of 60 days after the storage period expires. An overdue storage fee of HK$200 per month will be charged in addition to the Bag Storage Subscription Fee owed for the period. - Disposal: We reserve the right to dispose of any items left at our facility 60 days after the storage period expires.
- Locker Access: You shall not share your locker password with anyone. Any loss resulting from the sharing of your password is not our responsibility.
Adjustment of Rates and Policies
- Adjustment of Rates and Policies: We reserve the right to adjust pricing for our services, merchandise, passes, packs and credit package. Any adjustments to pricing of services, credit package, packs and pass will be communicated with a minimum of 3-month notice.
- Adjustment Ceiling: Pricing for Facility Rental services are adjustable according to current operation and market conditions, subject to an 8% annual increase ceiling.
Conduct
- Prohibition from Providing Unauthorised Services: Lessons must only be conducted by professionals approved by the Company.
- Proper Attire: You are required to wear appropriate attire at all times on our premises.
- Dress Code: Undressed or naked individuals are prohibited in all areas of OGP.
- Privacy and Consent: Video recording of any customers on our premises without consent is strictly prohibited.
- Prohibited Activities: Illegal betting, gambling, drunkenness, foul language, or other misconduct are prohibited.
- Smoking Policy: Smoking of cigarettes, cigars, pipes, and e – cigarettes is prohibited on our premises.
Sales and Promotions: Selling or promoting any non-OGP products or services at our Premises without the Company’s consent is prohibited. - Respect for Others: All individuals must respect the comfort and safety of others within the Premises.
Termination
We reserve the right to terminate your account under the following
conditions:
- Immediate Termination Without Notice: If your conduct, whether or not the subject of a complaint by another customer, is deemed by us to pose a threat to the security, safety, or health of other customers or staff, or constitutes a material breach of the Terms and Conditions.
- Termination Upon Notice: If we determine that you are unsuitable or unfit for continued use of our facilities.
All decisions made by OGP under this section are final and binding. Termination of your account with OGP will result in the forfeiture of any Spending Credits and Session Tokens, with no right to a refund. Upon termination, you must return any property provided or assigned to you by OGP and settle any outstanding amounts owed. We reserve the right to amend, vary, delete or add to these Terms and
Conditions at any time without prior notice.
In case of dispute, our decision shall be final.
